FINANIME TERMES OF SERVICE

1. General Terms and Conditions

These terms and conditions apply to Finanime Sekai (later Finanime) and its customers.

The terms and conditions specified by that service provider shall also apply to the services and products provided by Finanime. Finanime has the right to update these terms and conditions without prior notice. Orders are subject to the terms and conditions that are written here at the time of placing the order.

Finanime shall not be held liable for damage caused by force majeure. Force majeure is defined as an unforeseeable circumstance or change in circumstances which is outside the scope of influence of Finanime.

2. Customer and Privacy

Finanime products and online store is aimed at consumers, not retailers. The trade relationship complies with all applicable Finnish and EU legislation. Children under 15 are not allowed to make purchases as customers, minors need the consent of their guardian to place an order.

When placing an order, the customer gives his consent in accordance with the EU's General Data Protection Regulation to process his necessary personal data. When placing an order, the customer is obliged to provide their complete and correct contact information, which includes at least name, address and telephone number and email address.

Customer information is saved in the Finanime customer registry where the data is used to facilitate the customer relationship between the customer and Finanime. The information is not used for direct marketing - only for the usual communication with the customer. Finanime will never disclose the data to a third party, except in matters relating to collection or invoicing and where the law so requires. If any individual or authority inquires about an individual customer or customers in general, we will notify the subject / customer of the inquiry immediately. We will never disclose the information without a written, lawful court order. Customer data will not be transferred outside the European Union. The customer (natural person) has the option to and if choosing to do so; register a personal user account for the service, all entered information must be accurate, current and truthful. One person may have only one user account at a time. Finanime reserves the right to maintain full control of all of it's systems, including (but not limited to) deleting an account without notice or terminating the service altogether. It's the customer's responsibility to keep their account username and password secret and never disclose them to others, Finanime staff or maintenance do not know and will never ask the customer for the account password.

The customer can check the information about themselves by contacting us Finanimen customer service. Contacts must be made in writing and signed to: Finanime Sekai, Torivoudintie 3, Liiketila 2, 00640 Helsinki. Our register statement according to the Personal Data Act can be seen here. The customer can at any time manage their own data and request their immediate and permanent removal Finanimen information systems, unless legislation, open invoices or recovery actions prevent the deletion of the data.

The website may use cookies to help make the website more user-friendly. The purpose of cookies is to enable, facilitate, improve and speed up the user experience. Cookies can also be used to provide better offers and more personalized product recommendations to the customer.

Finanime offers an optional subscription for a free newsletter delivered by email. upon subscription only the e-mail address is collected. In order to prevent misuse, Finanime will technically verify (by a confirmation link) that the subscriber has access to the specified e-mail address before starting the distribution. The customer can unsubscribe from the newsletter at any time by clicking the unsubscribe button in the newsletter. Finanime reserves all rights in the newsletter and its contents and reserves the right not to publish the newsletter without notice. The subscriber of the K18 version declares that he is of legal age when placing the order.

3. Pricing

The prices include VAT and the transport carried out by Posti Oy on behalf of the customer in Finland, to the pick-up point chosen by the customer, alternatively to the office chosen by Posti or Finanimeat the discretion of the delivery address in connection with daily delivery. The customer is always responsible for the correctness of the address information, as well as for the self-initiated reporting of any changes to the address information after placing the order Finanimeto, without a different notification, the order is always delivered based on the address information provided by the customer. The customer is responsible for the costs arising from the redirection of the shipment due to incorrect information.

The prices do not include additional Posti services that the customer may have taken (including but not limited to: cash on delivery, home delivery, perishable). As a rule, we do not deliver outside the EU, when delivering to other EU countries, an additional shipping fee is added to the price. The shipping fee is determined by the size and weight of the product and the accompanying packaging, and taking into account the significantly varying packaging sizes of the sales articles, it is more reasonable for customers to calculate the shipping costs per product and include them in the prices. If desired, we will break down the costs on a separate request. If there are clear price errors in the price list, the product will not be sold at a clearly lower price if it can be assumed that the customer has understood the existence of the error.

We check the prices at the time of order processing. If the price of the product rises before the order is shipped, we will deliver them at the original price.

Delivery times are purely estimates and are based on information provided by suppliers. Finanime or its the suppliers are not responsible for delays caused by unforeseen changes outside its scope. Finanime does not sell its products for resale.

The age limits of the products are observed as the law requires. Ordering R-18 products requires age-gate confirmation of being of legal age, XNUMX years or older.

4. Delivery

We aim to process the order within two working days of receiving it. In this context, an order means an order in which all products are immediately available in our warehouse, and the payment for the order has been accepted. If incorrect or malicious orders are made in the name of the customer, Finanimethe right to refuse to deliver orders to that customer.

Finanime is not obliged to reserve other products of the same order to the customer if any one or more product(s) in the order are unavailable, or their delivery is noticeably delayed for reasons beyond Finanime control. The customer can accept either post-delivery of the delayed product or cancellation of the product order. Any additional postage for will be charged separately (applies mostly to orders delivered outside Finland). The products in the order will be reserved for a maximum of 7 days, after which the order will be canceled unless the customer has agreed to post-delivery by Finanimes terms.

5. Pre-orders

Finanime provides the customer with a pre-ordering system that allows the customer to reserve a product to order before it is released. Finanime reserves all rights to manage its pre-ordering system, including but not limited to access rights management.

Pre-order is binding. As a general rule, no advance payment is required for a reservation made through the pre-ordering system*, a payment request e-mail will be sent when the product is released, allowing the order to be delivered within a reasonable time after payment (reasons outside the control of Finanime such as delays of the supplier and the transport company may affect the delivery time). If the customer wants to pay for the pre-order in advance before release, please contact Finanime and payment link will be sent.

* For some pre-orders, an advance payment is requested as a pre-payment. This will not be refunded if the order is canceled due to reasons regarding or by request of the customer. These products are ordered separately for the particular customer, the procedure is always clearly marked on the product page and the pre-order is only confirmed after the advance payment has been made. Cash on delivery is not accepted as a payment method for the prepayment.

If the customer wishes to cancel his pre-order, the customer must contact him Finanimenot in writing, for example by e-mail including the pre-order number or by replying to the pre-order confirmation message, keeping the previous message thread. One or more pre-order cancellations by the customer may result in, among others but not limited to, Finanimen limitation or loss of access to the pre-ordering system.

Finanime reserves the right to cancel a pre-order if there is force majeure (for example, a situation where the manufacturer is unable to deliver a sufficient number of products to resellers and some or all of the reservations have to be canceled, or licensing changes and sales are not possible in Finland). Finanime notify customers whose reservations are affected without delay.

Finanime reserves the right to ask the customer to identify themselves by means of a secure payment transaction. Confirmation is requested only in exceptional cases where the customer's purchasing behavior is atypical; the procedure is aimed to prevent for example: fraudulent orders (deliberately placed in the name of another) and thus is to the safety of the customer. In this case, the customer must perform a payment of one (1) euro using the Visma Pay payment method via an invoice, link, secure product page or otherwise provided by Finanime. After a successful payment transaction and confirmation of the identity of the person placing the order Finanime will refund the payment to the customer without delay.

6. Payments

FinanimeVisma Payments Oy, PayPal and Klarna act as payment intermediaries.

Via the Visma Pay service, you can pay with online banking credentials, wallet, payment cards (credit/debit), invoice or installment payment. Alisa Invoice is a flexible and safe payment method. The payment method is suitable for all consumers over the age of 20 for all types of purchases. 7. Returns

In distance sales, the customer has a 14-day right of cancellation in accordance with the law. If the customer wishes to cancel his order and return the product, we must first contact us immediately, primarily by e-mail to asiakaspalvelu@finanime.fi. In the reply message, we give instructions on how to make a return, the customer is responsible for the postage costs of returning a defect-free product. When returning, remember to mark the shipment as "customer return".

A new product must be unused and unopened/factory sealed in its sales packaging, a second hand product must still be in its packaging in the condition in which it was delivered to the customer. If the original product packaging is not returned in the same condition or is missing, Finanime shall only refund up to 20% of the value of the product, the product packaging is to be considered "part of the item" due to the nature of the hobby.

The customer is to keep all documents related to the customer return carefully until Finanime has replied with the instructions, a proof of purchase may be required. By law, the customer must make the return without delay, no later than 14 days after receiving the instructions.

Restrictions on the right of return are determined in accordance with Chapter 6, Section 16 of the Consumer Protection Act.

Games, films, software, collectible cards / posters packaged by the manufacturer in “random order” or other similar sealed products are non-refundable once the product packaging has been opened.

Hygiene and intimate products do not have a right of return after opening the package, as the product is not returnable for sale due to its nature. Hygiene and intimate products include e.g. headphones, bedding, towels and other textiles.

According to the Consumer Protection Act, service products or digital content do not have the right of cancellation if the performance of the service has started or the electronic delivery of digital content has started after the customer has given his consent to start delivery.

Returned products must be carefully packaged, the customer is responsible for the direct costs of the return in accordance with the price list of the carrier of their choice. An undisclosed package is considered a customer return (passive return) in which case the customer will be charged the actual postage and handling costs of the return, however at least € 10,90. If expenses are not paid, Finanime will not deliver any more orders to the customer in the future. Finanimedoes not have a regularly open permanent office where the customer can bring the return in person or through another agent, the return can be made at the Oulunkylä pick-up point according to the opening hours and booking status.

8. Warranty, Support and Liability for Defects

The warranty is determined in accordance with the warranty conditions specified by the manufacturer. The customer is obliged to read the warranty conditions supplied with the product before using the product. Warranty conditions can be found in the operating instructions, a separate warranty form or the web address provided by the manufacturer. The warranty only covers defects in workmanship and materials in the product, and does not cover normal wear and tear. The warranty period is specified in the product information. If the warranty period is not specified in the product information, it is one year (12 months) from the date of purchase.

Warranty repairs are always carried out in accordance with the manufacturer's or importer's warranty conditions

The responsibility for digital recordings is always determined by the risk liability. Finanime is not responsible for the data or software stored on the digital media at the customer's risk. Backup is the responsibility of the buyer.

9. Complaint

The customer is obliged to present a proof of purchase, a receipt or other proof of the place and time of purchase in connection with the return or when claiming a defect in the goods. Finanime reserves the right to charge the purchaser for the cost of searching for the receipt.

Complaints will only be processed in writing. A free-form complaint can be submitted either by e-mail to asiakaspalvelu@finanime.fi or by letter. The website has the option to leave customer feedback.

Dispute Resolution and Jurisdiction: The Consumer Customer shall have the right to submit any dispute arising out of this Agreement to the Consumer Disputes Board (www.kuluttajariita.fi) to be resolved. Before taking the matter to the Consumer Disputes Board, the consumer must contact the consumer advice of the magistrates (www.kuluttajaneuvonta.fi). The customer may file a claim for disputes arising from the contractual relationship Finanimea against either Finanimen in the district court of his domicile or in the district court of the locality in whose jurisdiction he resides. If the Customer is not domiciled in Finland, disputes will be settled Finanimen the district court of the domicile.

Attorney's fees are not reimbursed. The Consumer Advice and Consumer Disputes Board provides assistance in resolving disputes free of charge.
